These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ApexBox ("we," "us," or "our") governing your use of the Safe Word mobile application ("App").
By accessing or using the App, you confirm that you are at least 13 years of age (or the minimum age of digital consent in your country), that you have read and understood these Terms, and that you agree to be bound by them. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Subject to your compliance with these Terms, ApexBox grants you a limited, non-exclusive, non-transferable, revocable license to:
This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App or any portion of it. All rights not expressly granted here are reserved by ApexBox.
You agree not to, and will not permit or assist any third party to:
Violation of these restrictions may result in immediate termination of your license and may expose you to civil or criminal liability.
Safe Word offers a one-time purchase ("Premium Upgrade") that removes advertisements and unlocks additional in-game features. All purchases are processed by the Google Play Store and are subject to Google Play's terms and refund policies.
By completing a purchase, you authorize Google Play to charge the payment method associated with your Google account. ApexBox does not directly process or store any payment information.
If you reinstall the App or install it on a new device, you can restore your Premium Upgrade at no additional cost using the Restore Purchases function within the App. The same Google account used for the original purchase must be active on the device.
Refund requests must be submitted directly to Google Play within the applicable refund window. ApexBox does not process refunds directly. To request a refund, visit Google Play order history.
We reserve the right to modify, discontinue, or alter the features included in the Premium Upgrade at any time. In the event of a material reduction in features, we will make reasonable efforts to notify users.
Safe Word may include virtual in-game items such as Undos, Hints, and Word Changes ("Virtual Items"). Please note:
The free version of Safe Word displays advertisements served by Google AdMob. By using the free version, you consent to the display of these advertisements. Purchasing the Premium Upgrade removes all in-app advertising.
We are not responsible for the content of third-party advertisements displayed within the App. The display of an advertisement does not constitute an endorsement by ApexBox of the advertised product or service.
The App and all of its original content — including but not limited to the game name "Safe Word," game mechanics, visual design, artwork, audio, code, and the ApexBox brand — are the exclusive intellectual property of ApexBox and are protected by copyright, trademark, and other applicable laws.
Nothing in these Terms transfers any ownership of our intellectual property to you. Feedback, suggestions, or ideas you submit to us may be used by ApexBox without obligation or compensation to you.
Safe Word is a single-player offline game and does not currently support user-generated content, online multiplayer, or social features. You agree to use the App only in a lawful manner consistent with these Terms.
ApexBox does not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APEXBOX, ITS OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF APEXBOX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN ALL CASES, APEXBOX'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO APEXBOX IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR $5.00 IF YOU HAVE MADE NO PAYMENTS).
You agree to defend, indemnify, and hold harmless ApexBox and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any third-party rights.
ApexBox may suspend or terminate your license to use the App at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or for any other business reason.
You may terminate your use of the App at any time by uninstalling it from your device. Upon termination, all locally stored data will be removed from your device and your license will immediately cease.
Sections 7, 9, 10, 11, and 13 of these Terms survive any termination.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the App that cannot be resolved informally shall be submitted to binding arbitration or the applicable courts of competent jurisdiction.
Before initiating any formal proceeding, you agree to contact us at jaiden@apexbox.app to attempt informal resolution. We will make good-faith efforts to resolve disputes within 30 days of notification.
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. For material changes, we will post a notice within the App.
Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.
